Earnest money while not a legal requirement is still strongly recommended for buyers to provide when they buy a house.  Earnest money is supposed to show that buyers are serious about buying a home  But earnest money is not the only true indication of seriousness as the fact of having a pre-approval letter also shows that a buyer is serious.
