Being in a car accident is a traumatic event for many reasons. Knowing your rights and entitlement to benefits following an accident can ease some of the stress during that traumatic time. Below are a few tips and some useful information for you to know if you are involved in a car accident:
- You do not have to give a recorded statement to the other driver’s insurer.
- If you do give a statement to the other driver’s insurer, they will use it against you.
- Your own insurance company will have you sign an authorization in order to obtain your medical records from 5 years before the accident.
- The reason for this is so they can blame your injuries on pre-existing conditions and deny you treatment they would otherwise have to pay for.
- Don’t be surprised if the adjuster tells you that some of your medical treatment is unnecessary. They know how expensive medical treatment is and they don’t want to pay for it.
- Unless you purchased optional benefits, you can only receive a maximum of $400.00 a week for income replacement benefits.
- These optional benefits will only increase your premiums by a few dollars a month.
- If you are a passenger or pedestrian and do not have insurance, your treatment will be covered by the at-fault driver’s insurance.
- If you are denied treatment you have the right to dispute the denial.
- Accident settlement offers are always way too low.
